Right now, Delta 8 THC products are very hot items. Many questions are being asked. Let’s try to answer some of them for you here.
Is Delta 8 THC Legal?
By the wording of the 2018 Farm Bill and FDA regulations, Delta 8 THC is not regulated. Therefore on the federal level, it is considered legal. The wording of legal federal documents explicitly state Delta 9 THC as a federally banned substance. It does not specifically mention Delta 8 products.
It’s important to note that each state has authority to legalize Delta 9 THC or not. The same holds true for Delta 8. Matter of fact, this kind of jurisdiction can come all the way down to a community or a county. There are states, counties, and communities that have outlawed CBD, let alone anything that has the name THC in it.
To simplify it for you, here is a quick list of the 11 states that have made Delta 8 THC illegal:
- Alaska
- Arizona
- Arkansas
- Colorado
- Delaware
- Idaho
- Iowa
- Mississippi
- Montana
- Rhode Island
- Utah
If your state is not in this list, Delta 8 THC should be legal where you live. Keep in mind that the status of Delta 8 THC is subject to change at any time in your state if legislators decide to classify it as a controlled substance. Check you state laws.
Delta 8 THC has been studied to treat chemotherapy side effects
Does that sound surprising? Believe it or not, this study happened all the way back in 1995 and registered with the National Institutes of Health in 2005. The study was started to see if Delta 8 could reduce or stop nausea and vomiting caused by chemotherapy. Here’s a link to the abstract from the study. Note that the study was not finished. No word on why they were unable to finish the study. Oftentimes, these studies are halted because they don’t have enough test subjects or for a lack of funding.
